1.1. This Agreement establishes the complete Terms and Conditions (hereinafter referred to as "Terms and Conditions"), which will be applied to Xitique M-Pesa you initiated.

1.2. These terms and conditions and any changes or variations thereto shall become effective on the date of publication.


2.1. In these Terms and Conditions, the following words and expressions (except where the context otherwise requires) carry the following meanings:

2.1.1. "Xitique M-Pesa" is a product that gives the customer the possibility to collect their money on a daily or weekly basis, made available through the M-Pesa Services;

2.1.2. "Customer" is a reference to the holder of an M-Pesa account that adheres to the product "X-M-Pesa";

2.1.3. "Customer Service Center" means any Retail Store of Vodacom or other retail establishments that are communicated as such to Customer by Vodafone M-Pesa from time to time;

2.1.4. "E-Money" means electronic money value shown on your M-Pesa Account, representing an equal amount in cash;

2.1.5. "Equipment" includes your mobile device, SIM Card and / or other equipment which, when used together, allows you to access the Network and your M-Dice Account;

2.1.6. "Xitique Menu" means the Xitique Menu inserted in the M-PESA menu;

2.1.7. "M-PESA account" means your mobile money account, which you own in the M-PESA System, whose registration is maintained by Vodafone M-Pesa;

2.1.8. "M-PESA Service" means the services provided by Vodafone M-PESA for issuing, withdrawing and transferring electronic money between Customers, based on its instructions, including recording all transactions, verifying, confirming and updating the account records of the Client;

2.1.9. "M-PESA System" means the system operated by Vodafone M-Pesa in Mozambique for the provision of M-PESA Services;

2.1.10. "M-PESA PIN" means your personal identification number, the secret code used to access and move the M-PESA account and interoperate with the "Xitique" Product;

 2.1.11. "Network" means the Global System for Mobile Communications (GSM) operated by Vodacom in Mozambique;

2.1.12. "Order" means a request initiated by a subscriber of the M-Pesa services, using the M-System through the Network;

2.1.13. "Contribution / Ticar" means the act of deposit in the Xitique account to collect money daily or weekly;

2.1.14. "SIM card" means the subscriber's identity module, which, when used with the appropriate mobile device, allows you to access the Network and use the M-PESA System;

2.1.15. "SMS" means a short message service consisting of a text message transmitted from one mobile phone to another or from a system to a mobile phone;

2.1.16. "Transaction Fees" means the fees associated with the product;

2.1.17. "Cancellation" means the act of canceling your Xitique contribution, before the due date;

2.1.18. "We," "our," mean Vodafone M-Pesa;

2.1.19. "You" or "your" means Customer and includes Customer's personal representatives.


 3.1. Before starting your Xitique via M-PESA System, you must carefully read and understand these Terms and Conditions that will govern the use and handling of the Xitique M-Pesa product.

3.2. If you do not agree to these Terms and Conditions, please do not initiate a Xitique contribution. Failure to accept these Terms and Conditions will make it impossible to join M-Pesa Xitique;

3.3. You will be deemed to have read, understood and agreed to these Terms and Conditions, when using or continuing to use and move your Xitique contributions;

3.4. These Terms and Conditions may be altered or varied by Vodafone M-Pesa from time to time and the continued use of your Xitique product constitutes your agreement to be bound by them of any change or variation;

3.5. Any changes to these Terms and Conditions will be communicated to you. 


 There are three types of Xitique:

4.1.1. Daily Contribution lasting one week:

• Deposit (contribution) occurs every day of the week, excluding Fridays;

• Payments will be made every Friday regardless of the day of subscription.

4.1.2 Daily Contribution with duration of one month:

• Deposit / contribution occurs every day of the month, excluding the last day of the month;

• Payments will be made on the last day of the month.

4.1.3 Weekly contribution with definition of number of weeks

• Deposit occurs every 7 days until the end of the selected period;

• The user has the option to choose the number of weeks that Xitique intends to do;


 5.1 To start a Xitique you must be at least 16 years old and be a registered and active subscriber of the M-PESA service.

5.2 You can start a Xitique contribution using the Vodafone M-Pesa My M-Dose application (My M-Dose or Smartphone App) or through the M-Dose * 150 # Menu.

5.3 You should have only one Xitique active at a time.

5.4 You are not required to contribute to the Xitique in each contribution cycle, at the end of the Xitique, you will receive the amount based on your contributions.

5.5 When canceling your Xitique before the expiration date, you will be subject to a cancellation fee.


 6.1 You can use the M-Weigh * 150 # Menu or the My M-Weigh application to see the amount that has already contributed to the M-Weigh Xitique.

6.2 A mini Xitique extract shall not be issued. All Xitique transactions will be reflected in your M-Pesa account statement.


 7.1 You hereby agree to pay all Transaction Fees due in connection with your use of the Services.

7.2 Each contribution to the Xitique is subject to a rate according to the current M-Peso tariff;

7.3 Other fees, expenses, taxes, duties and taxes will be applied in fulfillment of your requests.

7.4 You are subject to a cancellation fee on the amount contributed until the date of cancellation, depending on your type of Xitique:

• In the daily Xitique, lasting one week, is subject to a cancellation fee of 5%;

• In the daily Xitique with a duration of one month, is subject to a cancellation fee of 5%;

• In daily Xitique with definition of number of weeks, is subject to a cancellation fee of 5%.


 8.1 Vodafone M-Pesa shall not be liable for any loss or damage suffered by you as a consequence of / or in connection with:

8.1.2 Unavailability of sufficient funds in your M-PESA Account;

8.1.3 Failure, malfunction, interruption or unavailability of the M-Pesa System and / or M-Pesa Service, of its Equipment and the Network, the causes of which are not attributed to Vodafone M-Pesa;

8.1.4 The money you have saved using Xitique is subject to legal proceedings or other encumbrances that restrict payments or transfers;

8.1.5 Your failure to give correct or complete instructions for incorrect contributions related to Xitique;

8.1.6 Any fraudulent or unlawful use of the M-Pesa Services, M-Pesa System and / or its Equipment;

8.1.7 Your failure to comply with these Terms and Conditions.


 9.1 Vodafone M-Pesa may send information regarding its Xitique via SMS to the Vodacom Mobile number associated with its M-PESA Account.


 10.1 You may contact the Customer Service Center to report disputes, complaints or discrepancies of Xitique M-Pesa.

10.2 This Agreement shall be governed by and construed in accordance with the laws of the Republic of Mozambique.


 11.1 The Privacy Policy and the Terms and Conditions of M-Pesa Services will be applied to Xitique, with appropriate adaptations.
